The Law Society Northern Territory (Society) is both disappointed and concerned at the media commentary over recent weeks concerning the decision by the Northern Territory Supreme Court to grant bail to a young defendant to attend a funeral in a remote community.

The Society further notes the recent Media Statement released by the Chief Justice of the Supreme Court in relation to this issue and whilst supportive of the statement notes that it is unfortunate that the Chief Justice had no option but to take the unusual step of issuing such a statement.

It is clear that the reporting of this issue by the media contained a number of factual inaccuracies and chose to omit relevant considerations taken into account by the Supreme Court in its decision to grant bail.

Whilst it is important and appropriate that such decisions be reported and commented upon publicly, it is equally important that such reporting and commentary be accurate, informed and respectful.

Society President Mr Richard Henschke said, “It is imperative that the media and others (including politicians) who comment publicly on such matters take utmost care to ensure the accuracy of their commentary. This is especially important given the conventions imposed on the Judiciary with respect to responding to public debate.”
