The Law Society Northern Territory (Society) is concerned about the recent announcement by the Northern Territory government that it will amend the Youth Justice Regulations 2006 to limit when children are eligible for diversion programs.

Diversion is an effective tool at reducing crime, with offenders who engage in diversion being half as likely to commit more crimes than those who are sentenced through the Courts. Diversion programs allow for children to have genuine opportunities at rehabilitation such that they come to recognise the harm their actions have for their victims and the community at large.

Society President Mr Richard Henschke said: “This announcement that less children will be eligible for diversion programs is disappointing given the current levels of youth crime and incarceration.

In light of recent amendments to bail legislation, the Society is concerned that these amendments will result in even more children being held in custody and put greater pressure on a court and prison system which is strained to breaking-point.

The approach to reducing crime and keeping the community safe must take into account evidenced based harm reduction measures and the practical effects on the justice system.”
