This workshop provides an introduction to Australian unfair contract terms law and its application to standard form small business contracts in the financial services sector. The workshop will cover:
• An overview of the unfair contract terms protections for small business in the Australian Consumer Law;
• An outline of ASIC’s regulatory activities and outcomes to date to ensure compliance with the unfair contract terms law by lenders; and
• A discussion about the types of terms considered to be unfair from a regulator’s perspective.

Jennifer Braw and Jae Lee are from ASIC’s Insurers team in the Financial Services Group which is responsible for the oversight of the retail financial services industry, including general and life insurance, retail banking, consumer and small business credit and electronic payments.
The Insurers team has primary responsibility for the supervision of general and life insurance providers. The team's broad range of work, including policy, analysis, research, industry review and surveillance work improves outcomes for consumers and industry, and contributes to ASIC’s vision of a fair, strong and efficient financial system for all Australians. The team actively engages with stakeholders to understand and facilitate innovation in the insurance industry.
Jennifer Braw is a Senior Manager for ASIC’s Insurers team having worked at ASIC for a number of years including in the misconduct and breach reporting and consumer protection teams, focussing on compliance. Jennifer has lectured part-time at the University of NSW School of Law as part of its general education program.
Jae Lee is an Acting Senior Lawyer in the Insurers team having worked at ASIC for a number of years focussing on areas of retail banking and consumer and small business credit.
Jennifer and Jae have led ASIC’s work to date in administering the unfair contract terms law applying to small business credit contracts.
