Overview

This seminar will examine the rights and obligations of parties to contracts for the purchase of units which have yet to be fully constructed, particularly from the point of view of purchasers seeking to avoid contracts and vendors seeking to enforce them.

In addition, from 1 July 2010 all vendors of land (with some exceptions) will be required to provide to a purchaser a disclosure statement containing certain particulars about the land. This presentation will also provide an overview of the new requirements as well as the format of the new forms. Some practical suggestions will be made as to how best to implement an office system and forms for vendors to sign when obtaining instructions. Marketing strategies will also be discussed.

Alistair has practised as a barrister for over 20 years both in Darwin and England, predominantly in commercial disputes.

Vincent has been at William Forster Chambers since October 2009 following one year as the senior commercial solicitor with Hunt and Hunt Darwin. He had his own practice in Victoria for 30 years handling all forms of conveyancing where pre sale disclosure has been compulsory since 1986.
